De Pol were retained to submit an application to remove an occupancy condition attached to a dwelling within the Green Belt near Huyton in Knowsley.
When the dwelling was originally granted planning permission the Council attached a condition restricting its occupation to a person solely employed in connection with an adjacent riding school or a person employed or last employed in agriculture. The riding school had subsequently closed and the subject dwelling was vacant.
De Pol demonstrated that the dwelling no longer had any function in terms of providing accommodation for the former riding school, was not part of an agricultural holding and that there was no evidence of a need to retain the property as an agricultural workers dwelling for the wider area.
The Council accepted the case presented and granted permission for the removal of the condition, thereby enabling the property to be sold on the open market. De Pol are currently advising the landowner of the potential for a residential redevelopment of the former Riding School buildings.
