De Pol are appointed by children’s theme parks owner Gulliver’s Theme Parks Ltd, who have sites in Warrington, Matlock Bath and Milton Keynes, to advise them on a range of planning related leisure issues.
Their Warrington site had secured planning permission on appeal 10 years ago for the extension of the theme park and the erection of an 80 bedroom hotel, although this was not fully implemented. De Pol were instructed to bring forward the development by negotiating further applications with the local planning authority.
Following the instruction of Barrister, Jonathon Easton at Kings Chambers, De Pol prepared and submitted an application for a Certificate of Lawfulness for the development based on a technical aspect of the planning acts. The certificate was granted based on De Pol’s submissions, the success of which relied on our practitioners having a detailed understanding of pre-commencement conditions and the meaning of ‘development’. This enabled the client to progress without needing to submit a further planning application.
De Pol have also been retained to advise the company in relation to possible future developments at other sites in their portfolio and assist them in the preparation of a Local Development Order for their new Rotherham site, for which a planning application submission Is pending.
